in any case, whether or not such losses were within the contemplation of the parties at the date of the Conditions, suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.

Shipton Mill Ltd reserve the right to modify or withdraw, temporarily or permanently, this Website (or any part of this Website) with or without notice to you. You confirm that Shipton Mill Ltd shall not be liable to you or any third party for any modification or withdrawal of the Website.

ACCOUNT CREATION

You warrant that the personal data which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; and

you will notify us immediately of any changes to the personal data by updating these details on your online account.

You must be at least 18 years of age (or a business operated by someone at least 18 years of age) to open an account with us.

You agree not to impersonate any other person or entity or to use a false name that you are not authorised to use.

You will be asked to create a password as part of the online account creation process. Your password must be kept confidential, and you will be responsible for all activities that occur and all orders that are submitted under its use.

We reserve the right to require that you change your password and or to suspend or cancel your account where we have reason to believe there has been or could be a breach of Website security.

The details you provide are governed in accordance with our Privacy Policy .

Your account with Shipton Mill Ltd is not a credit account and payment will be required when your order is processed.

It is your responsibility to obtain the necessary services and tools to manage your Shipton Mill Ltd account, and at your own cost (computer, internet connection, telephone etc).

INDEMNITY

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your personal information.

You are not entitled to assign, sub-license or otherwise transfer any of your rights under these Conditions.

Terms of Sale

DELIVERY

Shipton Mill Ltd will endeavour to process and despatch your order within 3-5 working days. Should a product not be available and if it is likely to be unavailable for longer than a week Shipton Mill Ltd will refund the value of that product and despatch the remainder of the order.

Shipton Mill Ltd use a third-party courier to deliver items. The delivery times are typically from 7:00am to 6:00pm Monday to Friday. Should a Saturday delivery be required please contact Shipton Mill Ltd and place your order over the phone as Saturday deliveries carry a surcharge. There are no Sunday or Bank Holiday deliveries, or on days when the courier is on strike. Please contact us if your order is over 100kg as it will be subject to a transport surcharge.

Regrettably we cannot accept payment via American Express.

Shipton Mill Ltd reserve the right not to deliver to all locations, or not to deliver all products to all locations.

It is your responsibility to make suitable arrangements to receive your delivery.

Shipton Mill Ltd cannot accept liability for any inconvenience or loss where we are unable to deliver to you, or deliver to you late, for reasons beyond our control (including, but not limited to, adverse weather, vehicle breakdown, traffic congestion, strike actions, supplier failures). Shipton Mill Ltd will refund you for any part of your order which is not delivered as the result of such delay.

UK delivery

Shipton Mill’s Flour Direct service only delivers to addresses in the UK. Details of our delivery area and charging structure are set out below.

NON-UK ORDERS

Flour Direct does not deliver to addresses outside the United Kingdom. If you would like to arrange a delivery of flour to an address outside the UK, please contact the Shipton Mill office directly.

As an exception, Flour Direct does deliver to the Republic of Ireland; except under circumstances mentioned below.

If you are not within the Flour Direct delivery area, but would like to order flour from Shipton Mill, please call 01666 505050 and we can discuss how we can get our flour out to you plus any additional charges which may apply.

 

For orders outside the Flour Direct delivery area, please note that any customs fees, duties and / or taxes associated with your order which may apply are the sole responsibility of the customer.

 

UK Mainland

We deliver to the UK mainland. This includes England, Wales, Scotland and Northern Ireland. Please note the following conditions that we must apply. Deliveries to places such as Scottish Highlands & Islands, Northern Ireland, Channel Islands, Isle of Man, Isles of Scilly and Isle of Wight will usually take two working days from despatch and will be subject to a surcharge.

Northern Ireland and Remote Areas

Sadly we, like many other UK companies, are subject to the charges applied by courier companies to deliver to postcodes deemed further afield by the courier. As a company however, we are very keen to support bakers throughout the UK and unlike some other companies we heavily subsidise this additional charge. 

Charges will depend on the size of an order; for the average Flour Direct order to remote postcodes we absorb £12 of the cost but regretfully we have to pass the remainder on to the customer. We are only a small company and on most of our orders to these postcodes our company actually makes a loss. Despite this, our philosophy is to continue to deliver the best possible flour and service to customers regardless.

Variable Charges:

For Northern Ireland, and Scottish Highlands and Islands

Standard delivery charges apply with a delivery surcharge of £6. Delivery will usually take two working days following despatch from the mill.

For Eire

We are able to deliver flour to the Republic of Ireland via Parcelforce’s Euro-Priority service, delivery is usually within 4 working days of despatch from the mill. 

For orders placed on our Website, we make every effort to include the applicable duty and tax, however there may be additional local duties and taxes that are out of Shipton Mill’s control that you may need to pay in order to receive the goods.

Almost all of our products can be shipped to the Republic of Ireland, with the exception of olive oil and fresh yeast.

 

For Channel Islands and Isle of Man

Standard delivery charges apply with a delivery surcharge of £6. Delivery will usually take two working days following despatch from the mill.

Charging structure

Our standard delivery charge for order values up to £29.99 is £6.00. There is an additional fee for deliveries to certain areas (see above for details). This reflects increased delivery costs that we are charged by the delivery company, some of which we must pass on to our customers.

FREE delivery

With the exceptions of Northern Ireland and remote areas we offer free delivery on orders over £30 up to a maximum weight of 100kg.


All deliveries will be made via courier service. Once you receive notification from Parcelforce, you may request an alternative date, delivery to a neighbour or to a local Post Office (maximum parcel weight restrictions apply in some smaller Post Offices, customers will need to check local arrangements).

PLEASE NOTE: There is no free delivery to Northern Ireland and those areas designated more remote by the courier companies - see above for details.

Orders placed in error

In the event that an order is placed to an address that we do not deliver to (see above for details), that order is invalid. Whether an order is invalid or not is entirely our decision. If your order is invalid, we will inform you by email sent to the customer email address and we will refund the payment for that order.

Errors in addresses

Please ensure your address is accurate when you place an order. In the unfortunate scenario of your address being input incorrectly, your order may be delayed, or the courier may not be able to deliver at all. If the courier charges us to redirect to the correct depot we will regrettably have to pass those charges on to the customer. The charge will apply also in the case of the order being returned to us due to incomplete/incorrect address.

If you realise your address details are incorrect once you have completed the ordering process, please contact us at enquiries@shipton-mill.com or 01666 505050 as soon as possible, ensuring you have your order number to hand. Whilst we can’t guarantee that we’ll be able to rectify the issue, we will try our best to update the address before the order is collected by the courier. 

REFUNDS

You must inspect your goods as swiftly as possible following delivery, and notify Shipton Mill Ltd promptly of any errors.

Should any product arrive damaged or unsuitable for use then please contact us at enquiries@shipton-mill.com within 2 days of delivery for a refund. In some cases we will ask for the product to be returned and we will organise its collection at a time to suit. Do not dispose of any such product unless directed to do so by our Customer Services or we may not be able to refund you.

CANCELLATION

If you wish to change or cancel an order before despatch, please contact us as soon as you can on 01666 505050 between 9:00am and 5pm Monday to Friday.

Please have the following details to hand:

- Customer name

- Order number

- Date of the order

Where possible we will try and prevent your order from being despatched but as orders are normally processed immediately we may have already packaged your order and sent it to you.

If this is the case then we cannot always stop the goods from arriving as ordered. In such cases, once you receive the order, you will have to return it to us within 10 days of delivery. If you wish to cancel and return the order within 10 days of delivery, we will refund the cost of the item & the cost of delivery but not the cost of returning the goods to us. We will only do this provided you have contacted us and informed us of your intent to do so and the goods have not been opened or damaged. Live yeast cannot be returned unless on chilled transport.

Contributors and contributed content

YOUR CONDUCT

You must not use the Website in any way that causes, or is likely to cause, the Website or access to it to be interrupted, damaged or impaired in any way.

You understand that you, and not Shipton Mill Ltd, are responsible for all electronic communications and content sent from your computer to us and you must use the Website for lawful purposes only.

You must not use the Website for any of the following:

  • for fraudulent purposes, or in connection with a criminal offence or other unlawful activity
  • to send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing; or in breach of copyright, trademark, confidence, privacy or any other right; or is otherwise injurious to third parties; or objectionable; or which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any “spam”
  • to cause annoyance, inconvenience or needless anxiety.

REVIEWS, COMMENTS, COMMUNICATIONS AND OTHER CONTENT

Users of this Website may post recipes, reviews, comments and other content; send communications; and submit suggestions, ideas, comments, questions, or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.” You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any content. Shipton Mill Ltd reserves the right (but not the obligation) to remove or edit any content.

If you do post content or submit material, and unless we indicate otherwise, you

  • grant Shipton Mill Ltd and its affiliates a non-exclusive, royalty-free and fully sub-licensable rights to use, reproduce, modify, adapt, publish, unpublish, translate, create derivative works from, distribute, and display such content throughout the world in any media; and
  • Shipton Mill Ltd and its affiliates and sub-licensees the right to use the name that you submit in connection with such content, if they choose.

You agree that the rights you grant above are irrevocable during the entire period of protection of your intellectual property rights associated with such content and material. You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content. You agree to perform all further acts necessary to perfect any of the above rights granted by you to Shipton Mill Ltd, including the execution of deeds and documents, at the request of Shipton Mill Ltd.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to Shipton Mill Ltd: (i) the content and material is accurate; (ii) use of the content and material you supply does not breach any applicable Shipton Mill Ltd policies or guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify Shipton Mill Ltd and its affiliates for all claims brought by a third party against Shipton Mill Ltd or its affiliates arising out of or in connection with a breach of any of these warranties.

DEFAMATION CLAIMS

Because Shipton Mill Ltd may not be aware of the contents of each recipe, comment or review, or any other content that is displayed, Shipton Mill Ltd operates on a “notice and takedown” basis. If you believe that any content on the Website contains a defamatory statement, please notify us immediately by contacting us at baker@shipton-mill.com or 01666 505050. Shipton Mill Ltd will make all reasonable endeavours to remove the defamatory content complained about within a reasonable time.

COPYRIGHT, AUTHOR’S RIGHTS AND DATABASE RIGHTS

All content included on the Website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Shipton Mill Ltd, its affiliates or its content suppliers and is protected by copyright, author’s rights and database right laws. The compilation of all content on this Website is the exclusive property of Shipton Mill Ltd and its affiliates and is protected by copyright and database right laws. All software used on this Website is the property of Shipton Mill Ltd, our affiliates or our software suppliers and is protected by copyright and author’s rights laws.

You may not systematically extract and/or re-utilise parts of the contents of the Website without Shipton Mill Ltd's express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this Website, without Shipton Mill Ltd's express written consent. You also may not create and/or publish your own database that features substantial (e.g. our prices and product listings) parts of this Website without Shipton Mill Ltd's express written consent.

COMPLIANCE WITH LAWS

The Website may only be used for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.

RESTRICTED RIGHTS

Shipton Mill Ltd makes no representation that materials at this Website are appropriate or available for use outside the United Kingdom, and access to them from territories where their contents are illegal is prohibited. If you choose to access this Website from outside the United Kingdom, you do so on your own initiative and are responsible for compliance with applicable local laws. You may not use or export or re-export the materials at this Website or any copy or adaptation in violation of applicable laws and regulations.

WAIVER

No waiver by Shipton Mill Ltd shall be construed as a waiver of any proceeding or succeeding breach of any provision.

SEVERANCE

If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

 

ENTIRE AGREEMENT

 

These Conditions govern Shipton Mill Ltd’s relationship with you. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these Conditions.

LIMITATION OF LIABILITY AND APPLICABLE LAW 

Shipton Mill Ltd’s entire liability under these Conditions will not exceed the purchase price of the goods in question.

Shipton Mill Ltd shall not be liable for any delay or failure in the performance of our obligations due to events beyond our reasonable control, such as but not limited to, accident, adverse weather, acts of God, civil unrest, disruption to energy supplies, equipment or supplier failure, fire, transport or traffic problems, terrorism or war.

These Conditions are governed by and will be construed in accordance with English law, and the English courts will have exclusive jurisdiction over any disputes which arise in relation to these Conditions.
